We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.

IF YOU DO NOT PROVIDE PERSONAL DATA

 

If we need to process the data you provide us with to fulfil our service, and you fail to provide that data when requested, we may not be able to perform the service, in which case, we may have to cancel a service you have with us. We will of course notify you if we need to cancel a service.

 

WHAT INFORMATION DO WE USE?

It only includes basic personal data required for us to communicate with you if you become a customer, and for you to be able to use our site, subscribe to our service or order our products and report a problem with our website. The information you give us may include your name, billing address, shipping address, payment information including credit card numbers' last 4 digits, email address, and phone number.

HOW DO WE SHARE YOUR INFORMATION?

 

Upon registration, your username and user ID will be linked to your activity on the website and displayed with the information provided on your profile (including your profile picture, if applicable) and any of your communications on the website (e.g. personal messages and comments).

  • Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

  • PayPal (Europe) S.à r.l. et Cie, S.C.A. (“PayPal”) based in the EU, for processing payments;
  • Stripe Inc. (“Stripe”) based in the US, for processing payments;
  • Amazon Web Services, Inc. (“AWS”), for our IT hosting on their servers based in Ireland;
  • Google LLC. (“Google”) based in the US, for the storage of documents that include your personal data on Google Drive, the use of Gmail in order to contact you about any services we provide to you and Google Contacts to store and maintain our clients’ details, and for Google Analytics which is used to analyse how other Google services are used;
  • Shopify, Inc. (“Shopify”) based in Canada, for powering our online store which you use to place and track orders; as our online shopping platform where customers can buy our products outside our website; this includes the shopify apps available in the shopify app store, examples of apps but not limited to: Kaktus pre-order, SkuGen, Easyroutes local delivery, Address check and validation, Order printer pro, Product search and merchandising, Post purchase survey, Stamped product reviews, Geolocation, Click & Drop, Full page zoom, Quick edit, Order printer, Order printer templates, Data feed watch, Xero bridge, Aircall. 
  • Xero Limited (“Xero”) based in the EU, Australia, Singapore and the US, to issue our clients with invoices for services we provide them with;
  • MINIMOTORS CO., LIMITED based in Republic of Korea, to provide the factory with a report about the number of customers or number of orders placed in a period of time which can sometimes include your details.
  • ZHEJIANG MINIMOTORS BIKE CO., LTD (recently changed name to 'ZHEJIANG DUALTRON ESCOOTER CO LTD') based in China, to provide the factory with a report about the number of customers or number of orders placed in a period of time which can sometimes include your details.
  • Dropbox Inc. (“Dropbox”) based in the US, to store and share documents and digital files;
  • Trello owned by Atlassian Cloud based worldwide, for instant internal communication which can sometimes be about you;
  • Facebook, Inc. based in US, for the storage of statistics, reports and analytics regarding campaigns and paid adverts efficiency.
  • DOLFINBLUE ACCOUNTING LIMITED based in the UK, as our accounting company, they have access to all our customers to make sure we keep the correct data, do the right accounting and include the necessary taxes.
  • Receipt Bank Limited based in the UK, it is used to store all business invoices for accounting purposes.
  • Kuehne + Nagel Ltd which is a part of Kuehne + Nagel Group based in Switzerland, it is our delivery company.
  • UPS  based in the US, it is our delivery company.
  • Royal Mail based in the UK, it is used to ship the parcels to the customers. 
  • Pipedrive, is an online software, otherwise called customer relationship management tool (CRM), it is used to keep record of our customers.
  • Zapier Inc. based in the US, it is used to integrate two platforms so we can create automation tasks without the need to do them manually.   
  • Klarna - In order to be able to offer you Klarna’s payment options, we will pass to Klarna certain aspects of your personal information, such as contact and order details, in order for Klarna to assess whether you qualify for their payment options and to tailor the payment options for you. General information on Klarna you can findhere. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarna’s privacy policy.
  • Yoti Ltd, based in the UK, used to verify our customer identity.
  • select business partners, suppliers and sub-contractors for the performance of any contract we enter into with you.
  • DHL, based in Germany, is a parcel delivery company.
  • DPD Group, is a parcel delivery company.

 

Other than as expressly set out in this Privacy Notice or as otherwise required or permitted by law, we will not share, sell, or distribute any of the information you provide us without your consent.

 

We will disclose your personal information (i) to any third party to whom disclosure is necessary to enable us to fulfil your orders and provide you with any service which you have subscribed to; (ii) where required to do so by law or court order; and (iii) to any person to whom disclosure is necessary to enable us to enforce our rights under this privacy notice or under other applicable terms.

 

This includes when:

 

  • We sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets.
  • The company or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Website Terms and Conditions and other agreements; or to protect the rights, property, or safety of the company, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

 

WHERE DO WE STORE YOUR INFORMATION?

 

All personal data we process is processed by our staff in countries outside the EEA including Canada and the United States of America.

For the purposes of IT hosting and maintenance, this information is located on servers outside the EEA.

Our external third party, Shopify, is based outside the European Economic Area (EEA), so their processing of your personal data will involve transferring your data outside the EEA.

 

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

 

  • Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe.
  • Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the US.
  • Appropriate security measures will be adopted to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage.

Once we have received your information, we have a Data Protection regime in place to oversee the effective and secure processing of your personal data and we will use strict procedures and security features to try to prevent unauthorised access.

 

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website at transmission stage; any transmission is at your own risk.

 

HOW LONG DO WE KEEP YOUR DATA FOR?

 

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

 

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

 

We are required under UK tax law to keep basic personal data about our customers (name, address, contact details) for a minimum of six (6) years after which time it will be destroyed.

 

In some circumstances, we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
